Purpose of the DDH
The DDH is for the sole purpose of registration and administration of STIHL dealers as well as their employees (hereinafter collectively referred to as “USERS”) for the pupose of usage of Users’ data in a plurality of STIHL internet applications. Any use for any other purpose is prohibited.
No claim for availability and performance
STIHL provides the DDH to the best of its abilities without remuneration. User has therefore no claim with respect of a particular availability or performance of the DDH or that the DDH is of a particular nature.
STIHL’s usage rights in the data
In the course of using the DDH, User will provide to STIHL data about himself, his company or his employees. By entering the User grants to STIHL and to STIHL affiliated companies within the meaning of sect. 16 of the German Company Act (Aktiengesetz) a permanent, worldwide, revocable, transferrable and sulicenseable right to use all data entered for the purpose of the business relationship with STIHL or STIHL affiliated companies.
No third parties’ rights
User ensures that he is entiteled to enter the data and to grant the usage rights referred to above and that there are no third parties’ rights in those data that may be detrimental to the usage rights granted to STIHL herein. User will hold STIHL and its affiliates harmless against all third party claims arising out of or in connections with User’s usage of the DDH.
Exclusion of liability
Our web sites are subject to constant change. STIHL puts outmost care in the design of its web sites. Still all content is provided without any liability for correctness or completeness. STIHL shall in no event be liable for direct or indirect damages under any legal theory based on the use of information and data on this web sites as long as these damage have not been caused by gross negligence or willful misconduct or in the case of damage to life or bodily injury.
